Acceptance of Terms

By accessing or using JamCrew, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. We reserve the right to update these terms at any time, and continued use of JamCrew after changes constitutes acceptance of the revised terms.

Description of Service

JamCrew is a multi-tenant software-as-a-service (SaaS) platform for live event crew management. The platform enables production companies, crew leads, and event organizers to manage crew profiles, post and assign gigs, coordinate schedules, process payments, and communicate with team members. Each organization operates within its own isolated workspace with customizable branding and configuration.

No Employment Relationship

JamCrew is a software tool. It is not an employer, staffing agency, labor broker, or employment intermediary of any kind. Use of the platform does not create an employment, independent contractor, agency, joint venture, or partnership relationship between JamCrew (or Made by Jam LLC) and any user, crew member, or workspace administrator.

  • Workspace administrators are solely responsible for the classification, compensation, tax treatment, and legal obligations related to their crew members.
  • JamCrew does not control work assignments, set pay rates, determine working conditions, or supervise crew. Those decisions are made exclusively by workspace administrators.
  • Nothing in these terms or in the operation of the platform shall be construed to create any employment or agency relationship between JamCrew and any crew member managed through the platform.

Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Each workspace must have at least one admin. You must be at least 18 years old to create an account.

Workspace Admin Responsibilities

Workspace administrators have elevated privileges and bear corresponding responsibility for their workspace. By creating or managing a workspace, administrators agree to the following:

  • Administrators are responsible for all content, data, and activity within their workspace, including content uploaded or actions taken by invited crew members and other workspace users.
  • Administrators must comply with all applicable labor, employment, tax, and data protection laws in the jurisdictions where they operate.
  • Administrators must obtain all necessary consents from crew members before uploading their personal data to the platform.
  • Administrators are responsible for the accuracy of payroll data, payment amounts, and crew classification decisions made through the platform.
  • JamCrew is not liable for administrator decisions regarding crew classification, compensation, scheduling, or any other operational matter managed through the platform.

Workspaces and Subdomains

  • One free workspace per account. Free-tier accounts may create one workspace. Additional workspaces require a paid plan.
  • Inactivity policy. Free-tier workspaces that show no login activity for 180 consecutive days will receive a deactivation warning via email. If no activity occurs within 30 days of the warning, the workspace will be deactivated and the subdomain released for use by other customers.
  • Subdomain reclamation. JamCrew reserves the right to reclaim, reassign, or release subdomain names from inactive or free-tier workspaces. Paid-plan workspaces are exempt from inactivity-based reclamation for the duration of their active subscription.
  • No squatting. Registering workspaces primarily to reserve subdomain names, without genuine intent to use the platform, is prohibited and may result in immediate workspace termination.
  • Subdomain allocation. Subdomains are assigned on a first-come, first-served basis. For free-tier workspaces, JamCrew reserves the right, at its sole discretion, to reclaim, reassign, or release any subdomain at any time, for any reason, including but not limited to trademark disputes, brand protection requests, or violations of these terms. Where practicable, we will provide reasonable notice before reclaiming an actively used subdomain. Free-tier customers do not acquire ownership of or permanent rights to any subdomain through registration or use. Paid-plan workspaces retain their subdomain for the duration of their active subscription.

Acceptable Use

You agree not to use JamCrew for any unlawful purpose or in any way that could damage, disable, or impair the platform. Specifically, you may not:

  • Use the platform to harass, abuse, or threaten other users
  • Scrape, crawl, or use automated tools to extract data from JamCrew without written permission
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Impersonate another person or entity, or misrepresent your affiliation with a person or entity
  • Upload or transmit viruses, malware, or any other malicious code
  • Use the platform for any activity that violates applicable local, state, national, or international laws
  • Register workspaces for the primary purpose of reserving subdomain names without intent to use the platform

Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice. If your payment method fails, we may suspend access to paid features until the balance is resolved.

Cancellation

You may cancel your subscription at any time from your workspace settings. Upon cancellation, your workspace will remain active until the end of your current billing period. After that, your workspace will be downgraded to the free plan. Data is retained for 90 days after downgrade, after which it may be permanently deleted.

Account Termination and Suspension

JamCrew may suspend or terminate your account or workspace access under the following circumstances:

  • Termination for cause. JamCrew may suspend or terminate your account at any time for violations of these Terms of Service, illegal activity, fraud, non-payment of fees, abuse of the platform, or conduct that harms other users or the integrity of the service.
  • Immediate suspension. In cases involving illegal content, security threats, or severe abuse, JamCrew may suspend access immediately without prior notice.
  • Notice for other violations. For less severe violations, JamCrew will make reasonable efforts to provide notice and an opportunity to cure the violation before terminating access.
  • Effect of termination. Upon termination for cause, your access will be revoked. Your data will be retained for 30 days to allow for export, after which it may be permanently deleted.
  • Appeal. If you believe your account was terminated in error, you may contact support to request a review.

Intellectual Property

JamCrew and its original content, features, and functionality are owned by Made by Jam LLC and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all data and content you upload to the platform. By uploading content, you grant JamCrew a limited, non-exclusive license to use, display, and process that content solely for the purpose of operating and improving the service.

Data and Privacy

Your use of JamCrew is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the platform, you consent to the data practices described in our Privacy Policy. Workspace administrators are responsible for ensuring that their use of JamCrew complies with applicable data protection laws with respect to their crew members' data.

Service Availability

We strive to maintain high availability of the JamCrew platform but do not guarantee uninterrupted access. The service may be temporarily unavailable due to scheduled maintenance, infrastructure updates, or circumstances beyond our reasonable control, including natural disasters, internet service disruptions, or third-party service outages. We will make reasonable efforts to notify users of planned maintenance in advance.

Third-Party Services

JamCrew integrates with third-party services for payment processing, hosting, authentication, and other functionality. With respect to these integrations:

  • JamCrew is not responsible for the availability, accuracy, or performance of third-party services.
  • Third-party services are governed by their own terms of service and privacy policies. Your use of those services through JamCrew is subject to those terms.
  • If a third-party service disruption affects JamCrew functionality, our liability is limited to making reasonable efforts to restore service within a reasonable timeframe.
  • JamCrew does not endorse or warrant any third-party service and is not liable for any loss or damage arising from your reliance on third-party services accessed through the platform.

Limitation of Liability

JamCrew is provided “as is” without warranties of any kind. To the maximum extent permitted by law, JamCrew and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.

  • Liability cap. JamCrew's total aggregate liability for any claims arising out of or related to these terms or your use of the platform shall not exceed the total fees paid by you to JamCrew in the twelve (12) months preceding the event giving rise to the claim.
  • Free-tier cap. For users on the free plan who have paid no fees, JamCrew's total aggregate liability shall not exceed one hundred US dollars ($100).
  • Data loss from deactivation. JamCrew shall not be liable for any data loss resulting from workspace deactivation carried out in accordance with the inactivity policy described in these terms, provided that reasonable notice was given.

Indemnification

You agree to indemnify and hold harmless JamCrew, Made by Jam LLC, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your violation of these terms, or your violation of any rights of a third party.

Modifications to Terms

We may revise these Terms of Service at any time. For material changes, we will provide at least 30 days notice by email or through a prominent notice on the platform before the changes take effect. Your continued use of JamCrew after the effective date of any changes constitutes your acceptance of the revised terms.

Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

  • Informal resolution. Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@jamcrew.io. We will attempt to resolve the dispute within 30 days.
  • Binding arbitration. If informal resolution fails, any dispute arising from these terms or your use of JamCrew shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Hall County, Georgia. The arbitrator's decision shall be final and binding.
  • Class action waiver. All disputes must be brought on an individual basis. You agree not to participate in any class, collective, or representative action against JamCrew.
  • Small claims exception. Either party may bring an individual action in small claims court in Hall County, Georgia, provided the claim falls within the court's jurisdictional limits.
  • Injunctive relief. Notwithstanding the above, JamCrew may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights, confidential information, or platform security.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and JamCrew regarding your use of the platform. These terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
